Holly James Concierge Terms and Conditions of Membership

The following terms of use apply when you view or use our service via our website at www.hollyjamesconcierge.com.

These conditions apply to all services used from or provided to you by Holly James Concierge and by requesting services from us, you agree that these conditions shall apply to the services you order/use.

.1. Definitions And Interpretation

1.1 In these Conditions, the following definitions apply:

Benefits: means the benefits made available to Members by Suppliers.
Member: a person registered as a member with Holly James Concierge
Membership: means membership of Holly James Concierge owned by Holly James.
Membership Fees: means the fees payable in respect of Membership notified to Members upon application for and prior to renewal of Membership.
Request: means a request placed by a Member with Holly James Concierge for Holly James Concierge to arrange the supply of goods and/or services from a third party on the Member's behalf.
Services: means the concierge and lifestyle management services provided by Holly James Concierge to its Members as part of their Membership.

Supplier means a supplier engaged by Holly James Concierge on behalf of and as agent for a Member to provide goods and/or services to that Member.

Website: means the website located at www.hollyjamesconcierge.com.

1.2 In these Conditions, the following rules apply:

(a) a person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality);

(b) a reference to a party includes its personal representatives, successors or permitted assigns;

(c) a reference to a statute or statutory provision is a reference to such statute or statutory provision as amended or re-enacted. A reference to a statute or statutory provision includes any subordinate legislation made under that statute or statutory provision, as amended or re-enacted;

(d) any phrase introduced by the terms including, include, in particular or any similar expression, shall be construed as illustrative and shall not limit the sense of the words preceding those terms; and

(e) a reference to writing or written includes e-mails.

2. Membership Applications

2.1 All Membership applications are subject to acceptance by Holly James Concierge at their sole discretion. Holly James Concierge shall notify applicants in the event that his or her Membership application has been accepted. Holly James Concierge is under no duty to disclose its reasons for rejecting any Membership application.
2.2 You are obliged to provide correct personal details when you apply for Membership. Failure to do so may invalidate your Membership and any subsequent transactions. Your responsibility to provide accurate information is a continuing obligation and you must notify Holly James Concierge promptly in the event that any information provided by you in connection with your Membership changes
2.3 Your Membership is personal to you. You are responsible for ensuring that no on uses your Membership.
2.4 We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with the Holly James Concierge privacy policy.

3. Membership Fees, Upgrades, Cancellations And Renewals

All services are provided on a retained basis.

3.1 Membership Fees payable shall be confirmed to you prior to acceptance of your Membership application. Any increase or decrease to the Membership Fees for subsequent years of Membership will be notified to all Members in advance of their Renewal Dates.
3.2 An initial two month commitment is required for all new clients. Services will not commence until this payment has been made by the client. The first two months' fees are payable in full, upfront, prior to the commencement of any services.
3.3 Following the initial two month period, the retainer will continue on a rolling monthly basis, with fees payable monthly in advance on the first day of each month by the member via a standing order of the agreed level of service and subscription.
3.4 Services shall not be provided until all payments are up to date and made in full on time.
3.5 Payments not received by the first day of each calendar month shall incur a 12% charge and need to be paid before services resume.

3.6 You acknowledge that your payment of the first two months constitutes your express request for us to begin to supply you with the Services.

3.7 Membership Fees are non-refundable.

3.8 You have the right to cancel your Membership until the end of 14 days after the day on which we accept your Membership application ("Cancellation Period") and we would ask that you inform us of your decision in writing (email will suffice).

3.9 If you cancel your Membership within the Cancellation Period, you will be reimbursed for your Membership Fee less deductions for the Services we have performed up until you informed us of your decision to cancel.

3.10 Holly James Concierge reserves the absolute right to cancel or suspend your Membership where it has reason to do so. If Holly James Concierge cancels your Membership, where it is reasonable to do so it is the members responsibility to cancel future payments. Future payments will not be refunded if cancellation has not been carried out by the member with their own bank or payment method.
3.11 Holly James Concierge reserve the right to refuse to provide the Services should any payment due under these Conditions not be received.
3.12 If, during the course of your current Membership, you wish to upgrade your Membership to a higher level of Membership or Holly James Concierge reasonably requests you to upgrade your Membership based on your usage of the Services, this will take affect in the following month's payment. If you do not accept Holly James Concierge's request for you to upgrade your Membership then Holly James Concierge reserves the right to cancel your existing Membership with immediate effect in which case the client is responsible for terminating any future payments with their bank or other payment method.
3.13 You have the right to cancel your membership at any point. You must give 30 days written notice after the minimum term. No refunds will be issued for payment in advance of retained services. Due to the nature of retainer based services if more than one month has been purchased, past the initial two month introductory period, any further months will be refunded less 1 months fee. This is at the discretion of Holly James Concierge.

4. SUPPLY OF SERVICES

4.1 Holly James Concierge shall supply the Services to the Member during the Membership in accordance with the Member's particular Requests, provided that Holly James Concierge shall not be required to provide or facilitate the supply of goods and/or services that it deems at its sole discretion may violate applicable laws, standards and/or regulations or may offend taste and decency in the relevant jurisdiction.

4.2 Holly James Concierge shall use its reasonable endeavours to meet any performance dates specified, but any such dates shall be estimates only and time shall not be of the essence for performance of any Services.

4.3 Holly James Concierge shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirement, or which do not materially affect the nature or quality of the Services, and Holly James Concierge shall notify the Member in any such event.

4.4 Services will be provided in English.

4.5 You acknowledge that Holly James Concierge reserves the right to accept commissions upon the supply of products or performance of services by any Supplier.

4.6 Quintessentially shall provide the Services using reasonable care and skill and, as far as reasonably possible, in accordance with your Requests and reasonable instructions from time to time.

4.9 Reservations, deposits, ticket requests and any other charges will be presented to the member and payment will be required before proceeding with any booking. Bookings are not guaranteed until such payment has been made.

5. SUPPLIERS

5.1 Suppliers are responsible for providing you with the services, products and Benefits you Request us to order on your behalf from time to time. Holly James Concierge shall communicate with Suppliers on your behalf unless it is more appropriate for you to contact the Supplier directly.

5.2 Suppliers may impose their own terms and conditions which, in every case apply to the supply of goods and/or services by that Supplier to you, and such terms and conditions shall be binding upon you at the time of order.
5.3 You acknowledge that the Benefits are subject to availability and may change from time to time without notice.

Please review the following terms carefully. By accessing or using the Service, you signify your agreement to these Terms of Use. If you do not agree to be bound by these Terms of Use in their entirety, you may not access or use the Service.

The Company respects the privacy of its Service users. Please refer to the Company’s Privacy Policy which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Service, you signify your agreement with the Privacy Policy as well as these Terms of Use.
